The state of Texas allows both judicial and non-judicial foreclosures. In comparison with other states, it is very easy for a lender to foreclose on a property in Texas. The entire process usually takes no longer than three months.
A non-judicial foreclosure is used when a mortgage contains a power of sale clause. This provision allows the lender to pursue a foreclosure without having to obtain a court ruling. Before scheduling a sale, the lender must first mail the defaulted borrower (homeowner) a default notice and give them 20 days in which to pay off all their debts. If payment still is not received, the lender can accelerate the loan, meaning he increases the value demanded to the full value of the original mortgage. In order to recover this amount he is owed, the lender may then schedule a foreclosure sale of the property.
A judicial foreclosure is only needed when no Power of Sale clause exists in the mortgage deed. In this case, the lender files a suit with the county court. The court then issues a ruling, and if it is in favor of the lender, the sheriff is instructed to conduct a foreclosure sale.
Twenty one days prior to the foreclosure sale, the lender must file a notice of sale with the county registrar. A copy of the notice must also be posted on the courthouse door. Although Texas foreclosure law, does not require the lender to publish the notice in a newspaper, it does ordain that the homeowner receive a notice at least twenty one days prior to the scheduled sale.
The foreclosure sale is usually conducted on the courthouse steps during the first Tuesday of the month. It is run by the lender’s trustee and is conducted in the style of a public auction property; the property is always awarded to the highest bidder.
Once payment from the bid has been received, the winning bidder is transferred full ownership of the property. After this is completed, however, the homeowner retains no right to gain back the property.
