Tennessee Foreclosure Laws

Judicial foreclosures are very rare in Tennessee. Most mortgages and deeds of trust contain a Power of Sale clause, which allows the lender to pursue foreclosure on a defaulted borrower (homeowner) without having to consult the judicial system. If a borrower is in default in this case, the lender can go right ahead and schedule a foreclosure sale.

However, if a mortgage lacks a Power of Sale clause and a judicial foreclosure is needed, the procedure is quite simple. The lender must first file a complaint against the borrower and in order to obtain a decree of sale from a court. Generally, if the court finds the borrower in default, they will give them a set period of time to pay the delinquent amount, plus any additional costs. If the borrower does not pay within the specified period of time, the court will then order the property to be sold.

In either case, the homeowner may stop the foreclosure process at any point up until the sale occurs by paying off their debt to the lender.

Prior to the sale, a Notice of Sale must be published three times in a local weekly newspaper. The first publication may appear no more than 20 days in advance of the sale. The Notice must contain the date and location of the sale, a description of the property and the lender's name and information. The Notice must also be posted in at least five public locations, including the county courthouse door. Under Tennessee foreclosure law, the lender does not have to mail the homeowner a copy of the Notice of Sale, although in many cases it is considered customary.

On the day of the sale, the lender's trustee auctions off the property to the highest bidder. The bidding may begin at no less than 50 percent of the property's fair market value. Once a winning bidder has been established, that person is issued a Certificate of Sale.

Unless waived in the original deed of trust, the original homeowner retains the right to redemption for up to two full years after the sale has taken place. In order to redeem, the homeowner must pay off the full amount of their original loan to the lender. If this period of time passes without redemption, the winning bidder is issued a deed and assumes full ownership of the property. The lender has the right to pursue a deficiency judgment against the homeowner for any debt not satisfied by the sale of the property.
