Wyoming is one of the least expensive States to live in in the United States, and it is also one of the least wealthy States, with its prices and average income coming in below average. However this doesn't mean that it isn't somewhere that people want to move to, and there are still thousands of people moving there every year. Found in the Western part of the United States in the mountainous area, the State of Wyoming is filled with mountains. These ranges take up about two thirds of the land mass of the State of Wyoming. The state of Wyoming allows both judicial and non-judicial foreclosures. A non-judicial foreclosure may occur if the mortgage contains a Power of Sale clause allowing the lender to pursue a foreclosure without obtaining a court ruling. In this case, the lender usually schedules a foreclosure sale after giving the defaulted borrower (homeowner) prior warning and a chance to pay off the default.
If a mortgage contains no Power of Sale provision, then a lender may file a suit asking the court to foreclose. If the court rules in favor of the lender, a foreclosure sale of the property is scheduled.
A Notice of Sale must be published in a local weekly newspaper for four consecutive weeks leading up to the date of the sale.
On that date, the property is auctioned off to the highest bidder. Anyone may bid, including the lender. Once a winning bidder is established, that person receives a Certificate of Sale.
The original homeowner is allowed three months in which to redeem ownership of their property by paying the full sale price of the property, plus a ten percent interest fee. If the homeowner fails to redeem, ownership is transferred to the winning bidder.
