South Dakota allows both judicial and non-judicial foreclosures. Judicial foreclosures are usually only necessary when there is either a problem with a property title or a mortgage lacks a power of sale clause. A power of sale clause provides the lender with the right to pursue foreclosure on a defaulted borrower (homeowner) without obtaining a court ruling. For a judicial foreclosure, the lender must file a suit against the homeowner. If the homeowner does not respond or cannot provide payment within a certain amount of time, the court is permitted to issue a ruling in favor of the lender and schedule a foreclosure sale of the property. Since most mortgages in South Dakota contain a power of sale clause, judicial foreclosures are hard to find. In the case of a non-judicial foreclosure, South Dakota foreclosure law does not require the lender to provide the homeowner with a notice of default before beginning the foreclosure process.
Before the sale can occur, a notice of sale must be published for a number of weeks in a local newspaper. The homeowner must also be given a copy of the notice of sale at least 21 days in advance.
Once these requirements are met, the foreclosure sale (which is run in the style of an auction) may proceed. A sheriff, who always conducts a foreclosure sale, auctions off the property to the highest bidder and presents that person with a certificate of sale, which transfers full ownership from the original homebuyer to the highest bidder.
If the property is less than 40 acres, then the original homeowner retains a right to redemption by paying off the full value of their mortgage loan within 180 days. However, the homeowner must inform the sheriff of their intent to redeem the property before the sale occurs.
