In Utah you can expect an arid to semi-arid climate. The winters are mild along the Wasatch Front where roughly 80% of its population resides. While Utah allows both judicial and non-judicial foreclosures, it is non-judicial foreclosures that are more common. These occur when the mortgage in question carries a Power of Sale clause, allowing the lender to pursue foreclosure without obtaining a court ruling. Any mortgage without this clause requires a judicial foreclosure, where the court decided upon the amount owed and gives the defaulted borrower (homeowner) a certain amount of time in which to pay. If payment is not received, the court schedules a foreclosure sale of the property.
For non-judicial foreclosure, the lender must file a Notice of Default with the county register and mail a copy of it to the homeowner. Once this Notice is recorded, the homeowner has three months in which to settle the debt. If this does not occur, the lender may schedule a sale of the property.
After the three-month grace period has expired, a Notice of Sale must be issued and published in a local weekly newspaper for three consecutive weeks. The first publication must appear no more than 30 days before the sale will take place. Copies of the Notice of Sale must also be posted on the property in question and at the office of the county recorder.
Foreclosure sales in Utah are conducted as public auctions, with the property being awarded to the highest bidder. If the sale price exceeds the value of the property, all extra proceeds are to be divided among any Junior Lien holders (other lenders from whom the homeowner might have received mortgage loans).
Unless dictated otherwise by the court system, the original homeowner retains no right to redemption in Utah. The lender may pursue a deficiency judgment against the borrower for the difference between the amount of the original loan and the foreclosure sale price. The lender may also be able to seize the property until the differing amount is paid.
