In the cases, which require disposition for the people concerned, a case management regulation is issued. Thus, all attorney and all the parties concerned in the foreclosure case will have to be present in the attorney court to during the scheduled time of the case.

For a definite proceeding of a foreclosure case, it is a required that the owner must miss at least three of his mortgage payments. It is after that only that any lender can file a case against his owner of the house. Almost seven months dissolve from the filing of a foreclosure case that the lender gets his property back to either auctioneer or sell it personally. Before the auction or selling of the house, the owner has full rights to stay in his home but as the foreclosure case is done, the owner looses all his rights.

Hence, this clears the fact that the lender can reoccupy his property and do whatever he wishes with the same as if either keeping it to him or reselling the same at either much lowers rates or auction it.

In many foreclosure cases, the money left to be paid is not even half the amount of the property involved but due to the non-payment of the mortgage payments, the whole property can be seized from the owner and be sold or auctioned by the lender.

Ways to avoid foreclosure case

It is very difficult to accept the situation of a foreclose case. Hence, it is always better to avoid the same. The best possible to way to avoid is to have a good relation with the lender. If one maintains a good relation with the lender, the foreclosures can be avoided.
