This move   would prevent the house going up for auction, but would cause the   homeowner to receive bad credit. The lender would then sell off the   homeowner’s personal effects in order to reclaim some monies lost. If   this is not appealing, then the homeowner should go and speak to the   lender. There are companies that will provide this service for free.   They can negotiate, on behalf of the homeowner, a complete reworking of   the original mortgage payments. This could even result in both lower   payments, as well as a lower interest rate.</p>

A  good outcome would include the following: a good understanding of the point of  view of all the parties involved and a good understanding of any options  involved. There would also be a realistic assessment of the affordability of  the home in question and of the homeowner’s finances. It  currently is 4th in the country for automotive manufacturing. Still,  unemployment is higher than the national average and people are losing their  homes. It is important now, more than ever, for people to know how to <strong><a href="http://www.foreclosurelistings.com/content/stop-foreclosure/state-governments-putting-stop-foreclosures.htm">stop  foreclosure</a></strong> in Alabama.</p>
<p>In Alabama the law permits  both judicial and non-judicial <strong>foreclosure</a></strong>. Non-judicial foreclosure is done  according to the power of sale clause in the original mortgage agreement. This clause  conveys the borrower’s assent to sale by the lender in case the borrower  defaults on the loan payments. The parties can proceed according to the methods  they specify at the time of the <strong><a href="http://www.foreclosurelistings.com/content/mortgages/how-to-recover-your-home-from-mortgage.htm">mortgage</strong> agreement or they can agree to follow Alabama’s Power of Sale  Guidelines.</p>
<p>Alabama’s foreclosure regulations state that the foreclosure sale can take  place at the door at the courthouse of the property’s county when the mortgage  is defaulted upon and after proper notice. A notice of the <strong><a href="http://www.foreclosurelistings.com/content/foreclosures/foreclosures-for-sale/maryland-foreclosures-for-sale.htm">foreclosure sale</a></strong> has  to be published in a local paper for 4 consecutive weeks in the county of the  property being sold. The notice must detail the type and date of the sale, the  name of the borrower, the mortgage provisions and how they were violated. The  last notice must be published 30 days before the planned sale date. Until the  day of sale, the borrower can stop the foreclosure by paying all past due  amounts. After the sale, the borrower still has 12 months to exercise the right  of redemption.</p>

<p>In Alabama, judicial  foreclosure is usually the route taken when the mortgage agreement doesn’t have  a power of sale clause or the clause is somehow invalid. The lender has to go  to the court in the county of the property at issue. They must file a petition  to foreclose with the court and the borrower can answer within 30 days. The  court holds a hearing and decides to dismiss the petition; renegotiate a new  agreement or grant the petition to foreclose. If the petition is granted, the  court sets an amount for the borrower to pay to stop the sale and gives them a  short date to remit the amount. If the borrower can bring the amount owed to  the hearing, the court is likely to dismiss the petition to foreclose. If the  amount is not paid, the court sets a date for sale. The borrower has another  chance to stop the foreclosure in Alabama  by paying the amount owed and any interests or costs before the date set for  sale.</p>
<p>If the bank won’t  renegotiate and coming up with the money is not feasible, the borrower can  declare bankruptcy (Chapter 13). This enters the mortgage into the bankruptcy  proceedings and will effectively stop the foreclosure proceedings.</p>

<p>The US economy is on a tailspin. Unemployment is at its peak. <p>The Federal Government had come up with a program by which loans of homeowners are being modified, first on an experimental basis, and then permanently. The program started off on a slow pitch. Now it has picked up pace. Yet the government has not been able to modify loans of 4 million people as agreed upon earlier.</p>
<p>Governors of various states are asking that lenders put a stop to foreclosures. That is because lenders have not followed the rules properly. Without verifying documents, they have approved documents. Even home sales have been stalled across the nation. Hence, buyers are left in the lurch. They do not know from where to buy properties. There is a scramble for living space across the US.</p>
<p>The government has also stopped foreclosure evictions. While this has helped many people, at the same time, it has stalled efforts to restore derelict properties. This has continued to affect certain neighborhoods in <strong>South Florida</strong>.</p>
<p>The nation’s 3 big lenders have decided to halt foreclosure. That is causing a tumultuous condition in the real estate industry. Experts say that people who were unaffected by the crash in the <strong><a href="http://www.foreclosurelistings.com/content/real-estate">real estate</a> </strong>market are now in a tight condition. Many of them want to buy homes but are not able to do so because of the government regulation. Even vacant homes can’t be cleaned as a consequence of this.</p>
<p>Take for instance, Norman Lachance. He has not been able to shift to a home despite having made the initial down payment. Lachance said, “I gave up my apartment because I was supposed to be in my home Oct. 1. I bought insurance, paid for an inspection, had the electricity turned on”. However, he was disappointed when he came to know that the property in <strong><a href="http://www.foreclosurelistings.com/list/FL/BROWARD/FORT LAUDERDALE/">Fort Lauderdale</a></strong> is on the do-not-call list.</p>
<p>Lachance says that he is very unhappy. Naturally, he paid $75,000 in cash, when he came to know that the closing has been canceled. He cannot even ask for his money as he will lose the hold over home. Lachance says that he does not know how long he would have to wait. The spokesperson of Fannie Mae Amy Bonitatibus said that she is not aware of Lachance&#8217;s case.</p>

<p>So far hundreds of <strong>foreclosures</strong> have been halted because of a court order. Bank of America is now pleading against this stoppage of sales in Utah. The federal judge has for the time being stopped the sales of BofA’s subsidiary ReconTrsut.</p>
<p>The attorneys of the mega bank were up in arms against the initial injunction issued on 22nd May this year. The plaint had been brought by a residential house owner of St. George Peni Cox. Her attorney claimed that the bank and its subsidiaries did not have the legal right to operate the sale in Utah because ReconTrust had failed to register itself for doing business with Utah Department of Commerce.</p>
<p>Christian Barlow lawyer based in St. George told Judge Clark Waddoups (District Court), “If it wants the power of foreclosure, it must comply with state law. If a bank is foreclosing in the state of Utah, it should have offices in Utah and allow people to negotiate with it face to face.”</p>
<p>But Roy Arnold, representing the bank, argued that a notice had been issued and injunction placed without going through the proper legal process. Sufficient time had not been given to the bank. Also Cox had not deposited a bond of security as mandated by the law.</p>
<p>The legal basis behind the injunction was also challenged by the lawyers of the bank. The laws of the state regarding registering do not apply to financial institutions of a national standing. These banks are under federal rules under National Bank Act.</p>
<p>It was further contended that the initial injunction was too general and has caused “significant harm” to the bank by obstructing the foreclosure sale proceedings – commercial as well as residential.</p>
<p>Barlow was challenged as to why the individual case of Cox became applicable to all the <a href="http://www.bankofamerica.com/"><strong>Bank of America</strong></a> foreclosures sales. It not being a class action she did not have a standing. Barlow said that Cox had not been residing in her house for many months as such the judge was mandated by the laws of the state to stop all BofA sales.</p>
<p>Currently 970 trustee sales of ReconTrust are pending in Utah as noted on its website. The case is significant because of the surge in <strong><a href="http://www.foreclosurelistings.com/list/UT/">foreclosures listings in Utah</a></strong>. It is reflecting the angst of the homeowners who are now delinquent by the thousands. They have tried but failed to contact the lenders directly and talk about the loans directly with the original holders of the mortgages.</p>
