The Bizarre Ways of Bank of America While Foreclosing
Bank of America has to be credited for resorting to weird and bizarre methods to foreclose. The bank is flexing muscles to evict a family residing in West Hartford although the couple has never failed once to pay their mortgage premium.
Bank of America is the largest in USA. Earlier in December it gave notice to Shock and Lisa Baitch that foreclosure action would start from Christmas Eve unless they agreed to a forced sale of their house.
Why was this weird move taken? Another branch of the bank had wrongly reported to a credit firm that the family wanted modification of loan. This led to their credit rating being ruined as the mortgage came to be branded as default.
A year previously Baitch had sought to refinance his loan to finance improvements to the house and also to consolidate his dues. The couple discussed the matter with a loan specialist of the bank who suggested they take part in the HAMP plan that would in effect brand them as being in financial trouble. However they backed out from the deal and opted for a conventional loan as they wanted to avoid incidental charges; it was not because they were alert to the HAMP plan’s ramifications. But it was too late. The credit agency had already been notified.
All this happened even though Bank of America had admitted to the error and dispatched a note of apology last
September. The case had subsequently been sent to the special section that deals with grave issues of customers. A promise was given that the credit agencies would be notified that the couple had never tripped and their financial position was in order.
Attorney Wendell Davis of Manchester said he had never come across such a case. Prior to taking the case Davis thoroughly went over the records of the couple and found that the allegations being made by Shock and Lisa Baitch were all true. Davis confirmed they had never faltered in their payments.
For the protection of his clients Davis is preparing a legal suit – there being no other way of hauling up Bank of America. The representatives of the bank have not yet responded to this move.
In another incident the activities of the bank was worse. It took the possession of a house that a couple from Massachusetts had paid for in cash. The bank rifled the belongings and altered the locks according to a legal suit filed in federal court by the couple.
